Privacy Policy for Candidates<\/h1>\r\n

PERSONAL DATA PROTECTION NOTICE CANDIDATES<\/h3> <\/div>\n\n

The Company Abacus Service S.r.l.<\/strong> (hereinafter also “Abacus Service”<\/strong> or “Company”)<\/strong> is the Data Controller and processes the personal data of its Candidates<\/strong> (hereinafter also “Data Subjects” or “Data Subjects”)<\/strong>, respecting the rights of the Data Subject, in a lawful, transparent and fair manner, in accordance with the provisions of Reg. 2016\/679\/EU (“GDPR”).<\/p>\n

1. Legal Basis (Art. 6 GDPR), Purpose and Nature of Processing
(why we process your data)<\/h3>\n

The Data Subject is informed that the Company will process his\/her personal data for the following purposes:<\/p>\n

    \n
  1. Pre-contractual fulfillments<\/span> (personnel selection) instrumental to the establishment of the employment relationship (publication of notice, selection interviews, acquisition of CV also through IT platforms and social networks such as Linkedin, etc.);<\/li>\n
  2. Fulfillment of legal obligations<\/span> (in the field of labor and social security law and social protection) or required by a regulation or European legislation.\n
      \n
    • Legal basis:<\/strong> the provision of data for the purposes set out in (1)<\/strong> and (2)<\/strong> is a requirement for concluding the contract and a legal obligation<\/strong>, and any refusal to provide such data will result in the impossibility for the Company to carry out the activities required for the conclusion and execution of the contract, as well as a violation of legal regulations that impose an obligation on the Controller. <\/li>\n<\/ul>\n<\/li>\n
    • Ensuring its<\/span> safety and security within the Holder’s premises (if the interview takes place on the premises).\n

      • Legal basis: safeguarding the vital interests of the Data Subject.<\/strong> he Data Controller may process your data where the Data Subject is physically incapable of giving consent (e.g., in the event of the need for emergency medical assistance to rescue the Data Subject).<\/li>\n<\/ul>\n<\/li>\n
      • Activities of managing the Company’s general secretariat (receiving and exchanging communications and correspondence via e-mail, telephone, fax, etc.).\n

        • Legal basis: consent of the Data Subject, optional.<\/strong> he failure to provide it, however, means that it will be impossible for him to receive communications addressed to him.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n

          2. Type of data processed<\/h3>\n

          (a)<\/strong> identification and contact information<\/span> (e.g., e-mail, tax ID, telephone number, full name, place and date of birth, etc.);
          \n(b)<\/strong> curricular data<\/span> (including personal images);
          \nc)<\/strong> special data<\/span> (e.g. health status, political or religious beliefs, membership in trade unions, etc.) are not required, but in the event that they are present in the CV or are spontaneously communicated (such as data suitable for revealing membership in protected categories), the Company processes only data relevant to the assessment of professional aptitude, to the extent that the acquisition of such information is strictly essential for the establishment of the employment relationship.<\/p>\n

          3. Time and mode of treatment<\/h3>\n

          Your data will be processed for 12 months after you are not employed or for 10 years after you cease to be employed, if any (please refer to the Personnel Disclosure in this regard).
          \nThe acquisition of the CV, therefore of the information entered in it by the Candidate, may also take place by means of computer platforms and social networks, such as the section of the Linkedin page where the Company, through its profile, publishes job offers.
          \nIn any case, all data will be processed fairly and transparently, through electronic and computerized means; they will be placed in special computer files, or in any other type of appropriate support, and kept under constant control with operational procedures and adequate protection measures to ensure the security and confidentiality of personal data, in order to prevent their loss, illicit or incorrect use and unauthorized access.<\/p>\n

           <\/p>\n

          4. Communication and dissemination of data<\/h3>\n

          The Company undertakes not to transfer the personal data provided by the Data Subject to anyone. However, they may be communicated to any third parties (whether appointed for this purpose as external Data Processors or as autonomous Data Controllers) for the sole purpose of fulfilling legal obligations, or, for example, at the request of the Judicial Authority, or where it is strictly necessary for the purposes of establishing the working relationship (in particular, prior to any employment, to the competent Doctor for the assessment of suitability for the job, etc.). <\/p>\n

          5. Rights of the Interested Party<\/h3>\n

          The Data Subject has all the rights provided for in Articles 15 et seq. of the GDPR. In particular, he\/she has the right to obtain access, rectification, deletion, portability of data, as well as the right to restriction of their Processing, the right to withdraw consent (without prejudice to the lawfulness of the previous Processing), to object to the Processing itself, and to lodge a complaint with a Supervisory Authority. These rights may be exercised by the Interested Party by means of a request addressed without formality to the Data Controller, to which an appropriate response shall be provided without undue delay and in any case within 1 month of receipt of the request, extendable by a further 2 months in the case of complex or numerous requests, by mail or fax to the addresses below, indicating on the envelope or sheet the words “Inherent to Privacy,” or by sending an e-mail to: privacy@abacusgroup.io<\/span> <\/p>\n
